Brazil Not Launching UN Case against Netherlands

THE HAGUE, Friday - Brazil will not submit a complaint to the United Nations against the Netherlands, President Luiz Inacio Lula da Silva said yesterday. He was rejecting a call by a court in his country.

Public broadcaster NOS reported yesterday morning that a Brazilian appeal court wants Brazil to launch a UN complaint against the Netherlands for the violation of child rights. The court was dismayed by the way the Netherlands has been treating two Dutch brothers-in-law who produced child pornography in Brazil.

On Wednesday, NOS reported, the appeal court in Rio de Janeiro sentenced the men in absentia to 21 and 17 years in jail. The court wants the Netherlands to extradite them and that the UN condemns the country for violation of the rights of the child, according to NOS.

Brazilian President Luiz Inacio Lula da Silva arrived in the Netherlands yesterday for a two-day state visit. He said he would not bring a case at the UN against the Netherlands. Premier Jan Peter Balkenende said the two countries' justice ministers would discuss the matter further.

The brothers-in-law were arrested in Rio de Janeiro in 2002. A year later, they were sentenced in absentia to 11 and 8 years in jail by a Brazilian court. But when the police wanted to arrest them, they turned out to have fled to the Netherlands.

The men fled on emergency passports given to them by the Dutch Consulate General in Rio de Janeiro. Brazil reacted with fury at the time and the Netherlands apologised.

In the Netherlands the men were then prosecuted on similar charges. On 24 October 2006 one of the two, described as Jerry K., was sentenced to 240 hours of community service. His brother-in-law Johan T. actually received no sentence at all and was released.

The two Dutch nationals have now been sentenced to 21 and 17 years by the Brazilian appeal court for abusing 24 underage Brazilian girls. They also made nude photos of the girls and put these on the Internet. The two are owners of the company Dutch Adult Entertainment.

Lula did not want to say much yesterday about the matter. Today he will have a government lunch in The Hague with Premier Balkenende. Lula was received yesterday by Queen Beatrix and laid a wreath on the National Monument on Dam Square with Amsterdam Mayor Job Cohen.
